Background
The client is of the opinion that the photographer has the necessary experience and abilities to provide services to the client.
The photographer agrees to provide such services to the client on the terms and conditions set out in this Agreement.
In consideration of the matters described above and the mutual benefits and obligations outlined in this Agreement, the client and photographer hereby acknowledge the receipt and sufficiency of such consideration and agree as follows:

These Terms and Conditions are set out in this agreement between Photography by Amanda Allen (Address: Exmoor Drive, Bromsgrove) and the client. - Peter Silverton Address:- ________________________________
for the provision of photography services by Amanda Allen. By engaging in home studio photography, outdoor sessions, weddings and other photography events, the client accepts these terms.
1. PURPOSE AND SCOPE OF PHOTOGRAPHY AND HOME STUDIO PHOTOGRAPHY
The purpose of this Agreement is to define the terms and conditions under which the Photographer will provide photography services. The photographer's relationship is a partnership focused on providing a service on a personal or professional level through photography.
The photography services provided may include, but are not limited to, the following:
- Directing posing positions
- Communication and thought process
- Offering support and encouragement to help the Client focus on the end result
- Providing positive feedback to encourage the client
2. ETHICS AND CODE OF CONDUCT
I am an experienced photographer, fully insured and DBS checked with a validated certificate. Adhering to a robust code of ethics involves several core areas:
1b. Photographing People
- Obtain Informed Consent: Always ask permission before photographing individuals or groups, especially in private spaces. Respect a refusal immediately and do not photograph someone who clearly feels uncomfortable.
- Protect the Vulnerable: Exercise extreme care when photographing children or individuals in crisis. Avoid exploitative imagery that strips people of their agency or dignity.
- Acknowledge power dynamics: Be aware of your positionality and privilege, ensuring subjects do not feel coerced into participating.
2b. Truth and Representation
- Avoid misleading edits: In documentary, photojournalism and wildlife photography, images will not be digitally altered to stage events or mislead the viewer.
- Provide context: Use honest, accurate captions so the photograph reflects the reality of the situation rather than a biased narrative.
- Disclose Commercial Relationships: If my work is sponsored, commissioned, or part of an advertisement, I will clearly disclose the arrangement to avoid deceptive practices.
3b. Nature and Wildlife
- Do No Harm: I will never bait, chase, drug or unnecessarily disturb animals for the sake of a photo.
- Respect the Environment: Follow local trail guidelines and "leave no trace" principles to minimise your impact on the ecosystem.
4b. Street and Event Photography
- Respect Personal Space: Even in public areas, be courteous; shoving a camera directly into someone's face or aggressively using a flash can be considered jarring and disrespectful.
- Know the Laws: Understand the photography laws within your jurisdiction, especially regarding privacy expectations, photographing on private property, and commercial use.
3. PHOTOGRAPHY SESSIONS
The studio sessions take place at my home address, which is located at Exmoor Drive, Bromsgrove. Unfortunately, there is a flight of stairs to access the studio, and it has no disability access. An alternative location with disability access, possibly the client's home, can be arranged. (please contact me for a further discussion.)
Amenities: As the studio is based in a home environment, there is access to a bathroom with a WC available for the clients to use. The area is cleaned prior to every visit. No food or drink is allowed in the studio unless permission is given by the photographer; this restriction is due to the camera equipment being damaged.
The studio is designed to capture high-quality images in a comfortable private environment. Unlike outdoor shoots, studio sessions eliminate concerns about weather or fading natural light, offering a consistent, relaxing and creative space where the focus is entirely on the subject.
Here is a breakdown of the typical studio photography on a subject.
- Preparation and consultation planning: Before the session, you will have a phone consultation or face-to-face, whichever you prefer. This meeting is to discuss your vision, outfits, and desired theme.
- Arrival: Upon arrival, you have access to my block-paved drive in front of my house, as well as road parking opposite. I will greet you, and we will go through the front porch and hall directly to the studio, which is located at the front of the property. (Once again, a different location can be arranged if you are unable to access the stairs).
- The atmosphere and setting of the studio may have lighting setups, soft boxes, reflections and various backdrops, both mechanical and clipped.
- Relaxed vibe: The atmosphere is generally designed to be fun, friendly and relaxed to help nervous clients settle in.
- Guided poses: As your photographer, I will guide you through the poses, paying close attention to highlighting your best features.
- Variety: The session often lasts 45 minutes to an hour and a half, during which you can change outfits to create a diverse portfolio of images. I have a privacy screen so you can change privately, and I'm happy to leave you in the room.
- Interaction: For family group sessions the focus is on capturing natural, candid and emotional moments in a relaxed manner.
- Technical precision: As your photographer, I will use consistent equipment to ensure every image is captured.
Cake Smash sessions:
- A cake smash session in the studio is a specially designed themed photoshoot that celebrates a baby's 1st birthday by allowing them to play with, eat, and smash a small cake. The cake will not be provided and must be supplied by the client. The restriction is due to allergens and nut allergies.
- The sessions last 1-2 hours; they usually start with clean classic portraits of the baby alone or with siblings to capture them before they become messy.
- Decorated Theme: A chosen theme as discussed prior to the session, for example, rustic, floral, bright colours or a themed backdrop, with the baby placed in front of a small cake to explore, eat and destroy, creating frosting-covered chaos.
- Bubble bath splash: A mini bathtub shallowly filled with warm water and bubbles for a splash. This activity serves as a bath clean-up method and an opportunity for more delightful, candid photos. Please bring your own bubbles if your child has skin sensitivity and a towel as well.
- Safety and Hygiene: The studio is thoroughly cleaned between sessions.
- Alternatively, you can choose a no-cake option, and I will provide a fake cake for the pictures and this can include a change of outfits.
Key aspects and Tips
- Child-led: As your photographer, I will work at the baby's pace, allowing them to feel comfortable in the studio.
- Flexability: Not all babies enjoy the texture of the cake, so we may use toys or small props to encourage interaction.
- Timing: Sessions are best scheduled around 11 months old if the photos are needed for a first birthday party.
- Comfort: We recommend bringing your favourite items to help keep your baby calm.
- Family included: you may wish to add siblings and yourself in the photos.
NO CHILD IS TO BE LEFT UNATTENDED IN THE STUDIO. IT IS THE RESPONSIBILITY OF THE PARENT OR CARER OF THE CHILD TO TAKE FULL RESPONSIBILITY. ABUSIVE OR UNRULY BEHAVIOUR WILL NOT BE TOLERATED, AND YOUR SESSION WILL END.
Outdoor sessions:
- An outdoor photography session is designed to be an enjoyable outing, with the focus on laughter, play and genuine interaction.
- Natural and candid: Open spaces allow for those spontaneous moments of joy, exploration and connection, resulting in authentic expressions.
- Beautiful backdrops: Locations like parks, woodlands or urban settings provide natural beauty and depth, with the scenery doing much of the work.
- Seasonal: capturing those beautiful sessions, from summer days and evenings to autumn leaves and colours, to the frosty and snowy ones. The correct clothing, hats, summer dresses, shorts and t-shirts, wellies, coats and the typical British weather all play an important role in the photo session. Advice closer to the shoot will be given on the colour theme you are looking for.
4c. Post sessions and viewing
- Editing: After the session, the photographer will edit, colour correct and retouch the images to create a polished final product.
- The reveal: A few days to 2 weeks after the shoot, you can either return to the studio to view the images or view them online via messenger or download them.
- Ordering: The final step involves choosing your favourite photos and selecting print, digital or framing options to display in your home.
4. CONFIDENTIALITY
All information shared by the client with the photographer, whether written or verbal, will be kept confidential. The photographer will not disclose any personal information or session content without the client’s written consent, except as required by law or in cases of imminent harm.
Break confidentiality only if:
There's a risk or harm to the client or others.
- Criminal activity is disclosed, or
- You're legally required (by court order) to know the safeguarding contacts (e.g., local authority and emergency services) if a risk arises.
5. PHOTOGRAPHER AND CLIENT RELATIONSHIP
- Photography is a collaborative process focused on professional images.
- Clients must be fully committed to achieving the best results for their images.
Clients' Responsibilities
- Arrive on time and be fully present and engaged during the photography session. If you arrive late for a photography session or leave early. I will not be able to extend the session beyond the allocated time. This is because other clients will be affected.
- Have full communication with the photographer and accept responsibility for personal decisions and outcomes of the images.
- Notify the photographer at least 24 hours/weeks in advance if a session needs to be rescheduled or cancelled. Failure to do so may result in the forfeiture of the session fee.
Photographers' responsibilities
- Provide a safe, supportive, non-judgemental environment for the clients.
- Maintain the highest of standards at all times
- Respect the clients' values and wishes
- Be on time and fully prepared for sessions as discussed with the client in previous discussions.
6. DEPOSIT AND PAYMENT
Upon successful payment of a 30% non-refundable booking fee, Photography by Amanda Allen will reserve the agreed-upon time and date and will not make any other reservations for that time and date. For this reason the booking fee/retainer payment of 30% of the full collection price is non-refundable or transferable in the event that the date is changed for the wedding/photoshoots or is cancelled for any reason, including acts of God, fire, strikes and extreme weather. The deposit is applied to the contracted photography package.
Payment in full for the remaining balance will be due 8 weeks (two calendar months) before the wedding day. The exact due date for the remaining balance will be stated in writing on the client's electronic invoice document.
A payment plan may be arranged between the photographer and client should the client wish to pay the remaining balance gradually.
No photographs, USB memory sticks, albums or additional photo products will be delivered until all payments due have been paid in full.
The client has the option to purchase additional products after completion; this contract is to be made in full at the time of orders.
Payments by BACS are preferred, and bank details will be provided on the electronic invoice. Once payment has been made, an electronic receipt will be sent for each payment or purchase.
Photography by Amanda Allen will accept credit card payments by Mastercard or Visa only, and such payments will incur an additional fee; this fee is due to the banking fee for processing the payment. Contact me if you wish to do so. No credit card details will be held, and a payment link will be sent to you directly to make the payment. The system used is SumUp. They will keep records of all transactions made on my account.
Photography by Amanda Allen creates a client record for each new contact form. Photography by Amanda Allen will have access to your personal data (email address) stored on file. You will not be added to any mailing lists and will only be contacted by Photography by Amanda Allen personally in relation to your inquiry. We will not use your personal details for any marketing purposes, and we will not pass them on to any third parties.
7. BOOKING FEE/RETAINER PAYMENT
A non-refundable booking fee of 30% as well as full acceptance and their contract secures the time and services of the photographer(s) for the wedding/photoshoot. The booking fee is non-refundable in the event of cancellation, being the agreed loss suffered by the photographer 12 months or more before the wedding/photoshoot date.
The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance.
8. IMAGES
Photography by Amanda Allen will present the client with a carefully chosen selection of images. The images will be provided in the form of JPEGs. The client will not have access to any unedited images or raw files. It is strongly recommended that the client save multiple copies of their images to avoid accidental loss or corruption of these images.
Photography by Amanda Allen will keep a copy of the images for 2 years. If you require a copy of these images, a charge of £75 will be required.
At church ceremonies or in certain venues, the official in charge may sometimes impose restrictions on the photographer's movements. Clients understand that the photographer must adhere to the venue's rules and are not liable for any inability to capture images if restricted during the ceremony. It is the client's responsibility to understand the rules ahead of time.
9. DELIVERY
Delivery of images shall be given via a private online password-protected gallery where the client may view, download and share their images. They may create a selection of favourite images and purchase additional professional printed products from the online shop integrated into their gallery.
Images will be delivered within 6-8 weeks of the wedding date and within 4 weeks of the photoshoot date. Photography by Amanda Allen will always strive to deliver your photographs as quickly as possible.
10. ARRANGEMENTS FOR YOUR WEDDING DAY
The details of the wedding arrangements are to be agreed beforehand in writing. The client must finalise a schedule of hours, location(s) and desired photographs with the photographer via the information question
The client will be responsible for completing and submitting the event guide questionnaire to Amanda Allen at least two weeks prior to the wedding date. The client shall notify the photographer of any changes to these details in writing. The role of the event guide is to identify specific times/people/objects that are desired, as well as to make certain that these subjects are available when needed. It is recommended that the clients develop a list of any desired locations and subjects (family and friends; items, etc.) and share these details with the photographer well before the wedding. If no one is available to assist in identifying or gathering people/items/locations for the photograph(s), the photographer is not responsible for failing to capture specifically desired photographs. The parties agree to positive co-operation and communication for the best possible result within the definition of this assignment. Photography by Amanda Allen is not responsible for missed images due to key individuals' absence, lack of cooperation, or undisclosed details.
As part of this agreement, the client is also expected to provide the photographer(s) with a meal on the wedding day. It is advised for this break to commence around the same time as the wedding breakfast.
11. CREATIVE LICENSE
The photographer(s) shall be granted artistic licence in relation to poses photographed and the location used. The photographer(s)' judgement regarding the locations/poses and number of images taken shall be deemed correct. The style and number of photographs also depend on the weather and the availability and willingness of clients and their guests. The photographer(s) will make every effort to honour requested photographs but does not guarantee any specific picture, background, location, or group arrangement. Due to the fact it is a "live" event, it may not be possible to capture all images requested.
12. RETOUCHING
All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The photographer's judgement regarding these corrections and the number of images put forward to the client for preview shall be deemed correct. Retouching, digital manipulation and artistic finishing are also included.
13. MATCHING COLOURS AND SIZES
Due to photochromic anomalies in certain dyes and materials, especially in man-made fibres, it is sometimes impossible to capture on camera the exact colour of the materials as seen by the human eye. When processing the images, Photography by Amanda Allen will endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs due to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical across the entire range of the subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors, it is understood that images may appear differently according to the specifications of each monitor and that prints will not match images rendered on any particular computer monitor.
14. COPYRIGHT
Clients acknowledge that all work created under this agreement is the intellectual property of the photographer, who shall retain ownership and all the rights to the copyright of the photographic materials. The Copyright, Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images, whether stored digitally or otherwise, and any computer, including any source or object code, computer files or printed documentation relating to such images, are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow the copying of an image created as part of this contract, whether photographically, electronically, or by any other means, without the photographer's written permission.
15. USE OF LICENCE
The photographer grants the client a licence of use. The Client has permission to make copies of the image under the following conditions: The images taken by the photographer are for personal use only by the client and their family and friends at no additional cost. The client does not have permission to use the photographs for commercial use. The photographs are not to be sold. The client will not have access to any unedited or RAW image files.
The client is not permitted to share photographs directly with other wedding suppliers. If the client is approached by a wedding supplier or wedding venue regarding the use of the photographs, the client must direct them to the photographer. The photographer, the client, and the third party in question shall then make an agreement for the usage of photographs.
The client may publish photographs to social media if they wish. Images may not be edited or have filters applied to them. The client agrees to not digitally manipulate the work for public viewing (social networking, websites or public photo galleries) and agrees to include a photo credit of "Photo by: Photography by Amanda Allen" with each selection of photographs shared.
16. DISPLAY YOUR PHOTOS
Photography by Amanda Allen may use images included in this contract on their website, portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially unless subjects express the wish for this not to happen prior to the event.
Photography by Amanda Allen, with your consent, will select photographs for these promotional purposes. Showcasing work is a key aspect of Photography by Amanda Allen's business, as it is paramount for promoting its services. The photographer will choose the best selection of photographs to showcase on the photographer's website, social media platforms, and, on occasion, promotional products. Photographs on occasion may be submitted to lifestyle photography blogs, wedding suppliers and photography-related websites, provided the images are used lawfully and without damage to Photography by Amanda Allen's clients.
Photography by Amanda Allen protects the rights of the people captured in these photographs. The photographer has unrestricted use of these images and can use them whole or in part in any publication (commercial or otherwise), portfolio or public display with any retouching or alteration without restriction. At events, it is the client's responsibility to notify guests of this unrestricted use and that their attendance acts as a model release.
17. CLIENT'S CONSENT
Amanda Allen respects the privacy of every client. Under the new GDPR law, every client photographed by Photography by Amanda Allen must now consent to the display of their photographs. The process for this is to tick the consent box at the end of this document.
By ticking this box of consent, the client hereby assigns the photographer the irrevocable and unrestricted right to use and publish photographs of the client(s). The client releases all claims to profits that may arise from the use of the images.
The client may not resell, relicense, or redistribute the photographs. Use it as a derivative work, and reselling or redistributing such a derivative work is prohibited. Images may not be used in a pornographic, obscene, illegal, immoral, libellous or defamatory manner. Images may not be incorporated into trademarks, logos or service marks.
18. PRINT RELEASE
The photographer grants the client a print release on all photographs for personal use only. There is no limit on how many times the photographs may be printed.
19. LIMITATION OF LIABILITY
While Photography by Amanda Allen takes the utmost care with respect to exposure, processing and delivery of photographs, in the event that the images become lost, stolen or destroyed, for reasons beyond the control of the photographer(s), liability is limited to a refund of the retainer and payment received. The limit of liability shall not exceed the contract price stated herein. The photographer(s) will not be held responsible for any ruined photographs due to any cause outside of their control.
20. TRAVEL EXPENSES
No travel expenses are applied to weddings within a 10-mile radius from Bromsgrove, Worcestershire, calculated using the postcode B61 0TW. Distances in excess of this limit will incur a small surcharge of 65 pence per mile. If your wedding venue is more than a 2-hour journey from Bromsgrove, Worcestershire, an overnight stay may be required, and there may be a charge for hotel accommodation. When documenting a destination wedding, my photography prices will remain the same, but there will be an additional charge to cover travel and accommodation expenses.
21. ADDITIONAL HOURS
We charge £100 per hour for any additional hours or for hours worked beyond the time set in your chosen package.
22. ATTENDANCE
In the unlikely event that the photographer(s) is/are unable to photograph the wedding day due to the following: illness, emergency or accident, every effort will be made to find a suitable replacement photographer. If unable to reschedule or obtain a professional replacement photographer, the payment(s) made to Photography by Amanda Allen will be refunded in full. The return of the payment(s) shall be the entire obligation under this contract. We do not recognise or warrant any other damages or guarantees.
23. CHANGE OF DATE/POSTPONEMENT
If the client needs to postpone the wedding and reschedules for an off-peak wedding season date (November-March) within 78 weeks (18 months) of their original wedding date, then, subject to the photographer's availability on the new date, the photographer and the client will execute a new contract, and all monies will be transferred over to the new date.
Should the new wedding date be more than 78 weeks (18 months) from the original date or postponed to a peak wedding season date (Friday-Sunday, April-October)? Then the postponement booking will involve a cancellation and retention of the 30% booking fee, followed by a new contract for the new wedding date.
The new booking will be subject to the photographer's increased annual prices, and therefore, you need to pay the current collection price in full.
If the photographer is unavailable on the new date, the contract will be cancelled and the client will be liable to pay a cancellation fee as stated in the cancellation section of this contract. Or, a carefully selected professional associate photographer will be agreed upon between the client and the photographer to photograph the wedding day on behalf of Photography by Amanda Allen. Such an arrangement will incur an additional fee to partially cover the cost of hiring the associate photographer for the wedding day. Photography by Amanda Allen will complete and deliver the remainder of the wedding photography collection.
24. CANCELLATION
The client may cancel this contract at any time by giving written notice to Photography by Amanda Allen, but in doing so may forfeit any monies paid. The written notice must be sent as a formal email to amandamallen@hotmail.co.uk. The date of cancellation shall be the date that the written notice was sent.
If the client cancels 16 weeks (4 months) or less before the wedding, then the client will be liable to pay the full invoice total of the wedding photography collection, excluding the material costs of albums or photographic products that have not yet been ordered.
If the client cancels within 17-35 weeks (5-8 months) prior to the wedding date, Photography by Amanda Allen reserves the right to charge a cancellation fee of 75% of the full invoice balance, excluding the material costs of albums or photographic products that have not yet been ordered.
For example:
Silver Collection Price: £1000 minus
75% = £750.00 minus £300.00 (30% booking fee)
= £450.00 to pay
If the client(s) cancel between 36 and 52 weeks (9-12 months) before the wedding date, Photography by Amanda Allen reserves the right to charge a cancellation fee of 50% of the full wedding photography collection, excluding the material costs of the albums or photographic products that have not yet been ordered. If the client(s) cancel 53 weeks (12 months) or more before their wedding date, Photography by Amanda Allen reserves the right to retain the non-refundable 30% booking fee. No other additional cancellation fee will be due.
25. REFUNDS
Due to the nature of digital photography and because all photographs can be viewed by the client in the gallery prior to purchase, Photography by Amanda Allen has a strict NO REFUND/RETURN/EXCHANGE POLICY once orders have been sent. Once a transaction is completed, we treat it as non-refundable. If a buyer has selected and purchased an incorrect photo, he/she must notify Photography by Amanda Allen immediately before receiving the incorrect photograph. Refunds will NOT be given due to "not liking a photo" after the buyer has already received the photograph, or any other reason. If a mistake photo is sent to the buyer, as documented on the invoice, Photography by Amanda Allen will send the correct photo to the buyer free of charge.
